Arbitration and class action waiver: please read Section 13. Except for small claims, disputes between you and Mindset are resolved by binding individual arbitration, not in court. You waive the right to a jury trial and to take part in any class or representative action. You may opt out within 30 days of creating your account by emailing legal@mindsetapp.us.
These Terms are an agreement between you and TRADETECH LLC, a Wyoming limited liability company operating Mindset ("Mindset," "we," "us"). Before creating an account, you are asked to tick a box confirming you are 13 or older and agree to these Terms and our Privacy Policy, including the arbitration agreement in Section 13. We record the version you agreed to and the time. By ticking that box, or by otherwise using Mindset, you agree to these Terms. If you don't agree, don't use Mindset.
You must be at least 13 years old. If you are under 18, you confirm that a parent or legal guardian has agreed to these Terms for you. You may only use Mindset for yourself, on a device you own or control.
Mindset uses Apple's Screen Time framework to place a short affirmation task (a "rep") between you and the apps you choose. You control which apps are guarded, how long your phone stays unlocked, and the difficulty, and you can turn Mindset off at any time in Settings.
Mindset is designed to help you build a habit of positive self-talk. We make no promise of any particular personal, professional, athletic, financial or health outcome. Results depend on you.
Mindset is a motivation tool. It is not therapy, counseling, or medical advice, and it is not a substitute for professional care. If you are struggling, please reach out to a qualified professional. If you are in crisis in the U.S., call or text 988 (Suicide & Crisis Lifeline), or call 911 in an emergency.
You sign in with Apple. Keep your Apple account secure; you're responsible for activity on your Mindset account. You can delete your account at any time in Settings → Delete account.
Phrases you write and answers you give are yours. You give us a limited license to store and process them only to provide Mindset to you. Your phrases are private to your account.
You agree not to: reverse engineer, decompile, or tamper with Mindset or its servers; access another person's account or data; circumvent security, rate limits, or the subscription; use bots or scripts against our services; interfere with or overload the service; or use Mindset for anything unlawful.
Mindset, including its design, software, and phrase library, belongs to TRADETECH LLC and is protected by law. We grant you a personal, non-transferable, revocable license to use the app for your own non-commercial purposes under these Terms.
You can stop using Mindset and delete your account anytime. We may suspend or end access if you violate these Terms or misuse the service. Sections that by their nature should survive (including 10 to 15) survive termination.
Mindset is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise that Mindset will be uninterrupted, error-free, or that it will block any particular app at any particular time. Screen Time behavior is controlled by Apple and may change.
To the maximum extent permitted by law, TRADETECH LLC and its members, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of Mindset. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or $50.
You agree to indemnify TRADETECH LLC against claims arising from your violation of these Terms or misuse of Mindset.
Except for claims in small claims court, any dispute arising out of or relating to these Terms or Mindset will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Sheridan County, Wyoming, or remotely, at your option. You and Mindset each waive the right to a jury trial and to participate in any class action, class arbitration, or representative proceeding. If this waiver is found unenforceable for a claim, that claim will be severed and heard in court. Opt out: email legal@mindsetapp.us within 30 days of creating your account with your name and a statement that you opt out of arbitration.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law rules. Any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to their jurisdiction.
These Terms are between you and TRADETECH LLC, not Apple. Apple is not responsible for Mindset or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to Mindset (including product liability, legal compliance, or intellectual property claims). If Mindset fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
We may update these Terms. If changes are material, we'll ask you to review and agree to them in the app before you continue using Mindset. Changes to the arbitration agreement won't apply to disputes that arose before the change.
